4. User Accounts

• Registration: Account registration and management are handled via our third-party provider, Clerk (https://clerk.com/legal/terms). You agree to provide accurate information during registration and keep it updated.
• Responsibility: You are responsible for maintaining the confidentiality of your account login information (managed by Clerk) and for all activities that occur under your account. Notify us immediately of any unauthorized use.
• Termination: We reserve the right to suspend or terminate your account at our discretion, without notice, for any violation of these Terms.

5. User Conduct and Acceptable Use

You agree not to use the Service:

• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.

• To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.

6. User-Generated Content (UGC)

Through our Quiz Maker feature and community features, you can create quizzes, post comments, and share content ("User-Generated Content" or "UGC"). You are fully responsible for all UGC that you contribute to the Service.

• License Grant:

  By submitting UGC to the Service (especially if intended for public display like user-created quizzes), you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such UGC in connection with operating and promoting the Service. You retain ownership of your original UGC.

• Responsibility & Standards:

  You represent and warrant that: (i) the UGC is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your UGC on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person. You agree your UGC will not contain material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate.

• Moderation:

  We have the right, but not the obligation, to monitor, edit, or remove UGC that we determine in our sole discretion violates these Terms or is otherwise objectionable. We take no responsibility and assume no liability for any UGC posted by you or any third party.

• No Compensation:

  Unless otherwise explicitly agreed in writing, you will not be compensated for any UGC you submit.

• Images and Media Content:

  All images and media content you upload or link must be: (a) your original content, (b) content you have legal rights to use (purchased stock photos, Creative Commons licensed, etc.), or (c) content that falls under fair use principles.

  You explicitly warrant that you will not upload copyrighted third-party images without proper authorization. We strongly recommend using:

  • Your own photographs or artwork
  • Free stock photo websites (Unsplash, Pixabay, Pexels)
  • Commercially licensed stock images

  We comply with DMCA procedures for copyright complaints and may remove content and suspend accounts for violations.

• Comments and Community Content:

  Your comments, replies, and other community interactions are subject to the same standards as other UGC. Comments may be displayed with your username/avatar and can be viewed by other users.

  We reserve the right to moderate, edit, or remove comments that violate these Terms or community standards.

• Platform Liability Disclaimer:

  You acknowledge and agree that you are solely responsible for all content you create, upload, or share through the Service. Users assume full responsibility for any infringement actions, and Quiz Cabin does not assume any liability for users' infringement activities.

  Quiz Cabin specifically does not:

  • Pre-screen, monitor, or approve user-generated content before publication
  • Verify the ownership or licensing status of images or media you use
  • Assume any responsibility for copyright infringement or other legal violations in your content
  • Guarantee the accuracy, legality, or appropriateness of user-submitted content
  • Bear any liability for intellectual property infringement by users

  Any legal consequences arising from your content, including but not limited to copyright infringement, defamation, or privacy violations, are your sole responsibility. You agree to indemnify and hold Quiz Cabin harmless from any claims, damages, or expenses arising from your use of the Service or content you submit.

7. Quiz Disclaimer

The quizzes provided on this Service are intended for entertainment purposes only. The results are not based on scientific study or psychological analysis and should not be considered professional advice or a definitive assessment of personality or character.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the operation or availability of the Service, or the information, content, or materials included therein. 10. Indemnification

You agree to defend, indemnify, and hold harmless Quiz Cabin and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

• Your use and access of the Service, by you or any person using your account
• A breach of these Terms or violation of any applicable law or regulation
• Content you post, upload, or share on the Service, including all UGC
• Copyright infringement, trademark violations, or other intellectual property infringement claims relating to your content
• Defamation, privacy violations, or other tort claims arising from your content or conduct
• Any third-party claims related to images, media, or other materials you use without proper authorization
• Your violation of any rights of another person or entity

This indemnification obligation survives termination of your account or these Terms.

11. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may do so via Clerk's provided methods or by contacting us. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we may provide notice (e.g., via email or a notice on the website) prior to any new terms taking effect.
